Whistleblowing

(It.) Legislative Decree no. 24 of 10 March 2023 implements in our legal system Directive (EU) 2019/1937 on the protection of persons who report breaches of Union law (known as Whistleblowing Directive).
In order to transpose the provisions introduced by (It.) Legislative Decree no. 24/2023, Ciemmecalabria Srl has put in place a Procedure that provides clear operating instructions regarding the subject, recipients, means of transmission and management of reports relating to “breaches”, as well as the protection measures envisaged.

Who can send the reports?
The reports may be sent, by way of a non-limiting example, by: employees, self-employed persons, holders of a collaboration relationship, freelancers, consultants, trainees, suppliers, persons with administrative or supervisory roles.

What can be reported?
The reports, which must be as detailed as possible, must pertain to the breaches that fall within the scope of art. 2 of (It.) Legislative Decree no. 24/2023. The regulatory framework uses the term “breaches” to describe all conduct, acts or omissions that harm the public interest or the integrity of the public administration or of the private entity and which consist in administrative, accounting, civil or criminal offences, unlawful conduct of interest pursuant to (It.) Legislative Decree 231/01 or violations of the organisation and Management and Control models; offences that fall within the scope of European Union or national laws, acts and omissions that harm the Union’s financial interests, acts and omissions relating to the internal market.

How to make a report?
Reports must be made by accessing the Whistleblowing platform that is accessible at the following link: https://ciemmecalabria.wb.teseoerm.com/
The IT reporting channel must be used as a priority.
Please refer to the Regulation for clarifications on the means by which reports can be sent.

Who receives the reports?
The management of the reporting channel and the checks on whether the facts reported are well-founded or otherwise are entrusted to a subject outside Ciemmecalabria Srl, that takes steps to ascertain the facts reported in compliance with the principles of objectivity and confidentiality, including possibly hearing the reporting person and any other subjects who can provide information on the facts being reported. For this purpose, the person managing the report may use the support and collaboration of external consultants or of the Company’s competent departments.
